Privacy Policy

Fabify is operated by 1048035 B.C. LTD, a corporation incorporated under the laws of Ontario, Canada, with its registered office at Office #645 145 ½ Church Street, Unit 5, Toronto, Ontario, M5B 1Y4, Canada ("Fabify," "we," "us," or "our").

We are the data controller of personal information collected through the Fabify web application and related services (the "Service").

This Privacy Policy describes how we collect, use, store, share, and protect your personal information when you use the Service. By using the Service, you agree to the collection and use of your information as described in this Privacy Policy. If you do not agree, please do not use the Service.

1. Accountability

The individual responsible for Fabify's compliance with applicable privacy legislation is a Privacy Officer, who can be reached at support@fabify.app.

Our Privacy Officer is responsible for overseeing our compliance with PIPEDA and applicable provincial privacy laws, and for addressing all privacy-related inquiries and complaints.

2. Information We Collect

We collect only the personal information necessary to provide and improve the Service.

2.1 Information You Provide

We collect information you provide directly to us, including:

  • Account Information: Your name and email address when you create an account.
  • Clothing Images: Photos of your clothing items that you upload to build your digital wardrobe. Images are processed solely for the purpose of wardrobe organization and outfit recommendations. They are not used for biometric analysis, facial recognition, or body measurement.
  • Style Preferences: Preferences you provide when requesting outfit recommendations, such as occasion and context.
  • Communications: Information you provide when contacting us for support, feedback, or inquiries.

2.2 Information Collected Automatically

We automatically collect certain technical information, including:

  • Approximate Location: City-level location data, used solely to retrieve weather data for recommendations. We do not collect precise GPS coordinates or store location history.
  • Usage Data: Information about how you interact with the Service, such as features used and session duration.
  • Device and Browser Information: Standard technical information such as browser type, operating system, device type, and IP address.
  • Cookies: Essential cookies for session management and optional analytics cookies. See Section 10 for details.

We do not collect precise GPS location data. We do not sell personal information. We do not use personal information for advertising profiling.

3. Consent

3.1 How We Obtain Consent

We obtain your consent in the following ways:

  • Account creation: By creating an account and accepting our Terms of Service and this Privacy Policy, you provide express consent for the collection and processing described herein.
  • Clothing uploads: By uploading a clothing image, you provide express consent for that image to go through automated processing.
  • Location data: By using the outfit recommendation feature, you consent to the collection of your approximate location for weather data retrieval.
  • Analytics cookies: By continuing to use the Service after being informed of analytics cookies, you provide implied consent. You may opt out via browser settings.

3.2 Withdrawing Consent

You may withdraw consent at any time:

  • Delete individual clothing items through the Service to revoke consent for their AI processing.
  • Request account deletion by contacting support@fabify.app to revoke all consent.
  • Disable analytics cookies through your browser settings.

Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal. Please note that withdrawing consent for core processing will affect our ability to provide outfit recommendations.

4. Legal Basis for Processing

We collect, use, and disclose personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

We process personal information based on:

  • Your consent — for clothing image uploads, AI processing, and analytics.
  • Performance of a contract — to provide the Service as described in our Terms.
  • Legitimate business interests — to improve the Service, maintain security, and prevent abuse.

We use the information we collect for the following purposes:

We do not use personal information for advertising profiling or sale to third parties. We do not engage in automated decision-making that produces legal or similarly significant effects on users.

6. AI Processing Transparency

Fabify uses artificial intelligence and automated processing to provide core features of the Service:

  • Clothing Analysis: When you upload a clothing image, it is sent to a third-party AI service for automated analysis. The AI identifies attributes of your clothing and stores the results as structured metadata in your account.
  • Image Processing: Your clothing images may be processed to create standardized visuals used within the Service. Your original photos are always preserved.
  • Outfit Recommendations: Our recommendation engine uses proprietary logic to combine clothing items into outfits based on contextual factors such as weather and your stated preferences.

AI-generated results are assistive and may not always be accurate. You may review and edit AI-generated data within the Service.

Third-party AI providers process data on our behalf under written agreements that include appropriate data protection safeguards. Under our agreements with AI processing providers, user-submitted data is not permitted to be used for model training purposes.

7. Sharing of Personal Information

We do not sell, rent, or trade your personal information. We share your data only with service providers necessary to operate the Service.

8. International Transfers

Personal information may be transferred outside Canada, including to the United States, where our primary service providers are located. Fabify remains accountable for personal information transferred to third parties in other jurisdictions, in accordance with PIPEDA's accountability principle.

Where data is transferred outside Canada, we ensure appropriate contractual safeguards are in place to provide a comparable level of protection. Please be aware that personal information transferred to the United States may be subject to lawful access requests by U.S. courts, law enforcement, or national security authorities under their domestic laws.

By using the Service, you consent to the transfer of your personal information to the United States as described in this section.

9. Data Retention

  • Account and Wardrobe Data: Retained while your account is active.
  • Upon Account Deletion: Personal data will be deleted within thirty (30) days, unless retention is required by law.
  • AI-Processed Data: Clothing tags and metadata are stored as part of your closet inventory and deleted with your account.
  • Anonymized Analytics: Aggregated or anonymized analytics data may be retained for up to twenty-four (24) months. Anonymized data cannot be linked back to you.
  • Legal Obligations: We may retain certain information longer if required by law or to resolve disputes.

Users are encouraged to maintain their own backups of uploaded images. Fabify is not responsible for loss of User Content except as required by law.

10. Cookies and Tracking

We use essential cookies for session management and optional analytics cookies. You may manage cookie preferences through your browser settings.

11. Data Security

We implement reasonable technical and organizational safeguards to protect your information, including:

  • Encryption of data in transit (TLS/SSL) and at rest
  • Secure authentication and access controls
  • Regular review of data collection, storage, and processing practices
  • Restricted access to personal information on a need-to-know basis
  • Infrastructure security monitoring

No system is completely secure. While we strive to protect your information, we cannot guarantee absolute security.

11.1 Breach Notification

In the event of a data breach involving personal information that poses a real risk of significant harm, we will:

  • Notify affected users as soon as feasible
  • Report the breach to the Office of the Privacy Commissioner of Canada as required by PIPEDA
  • Maintain records of all breaches as required by law
  • Take immediate steps to mitigate harm and prevent recurrence

12. Your Rights

Under PIPEDA and applicable provincial privacy legislation, you have the following rights:

12.1 Access

You have the right to request access to the personal information we hold about you and to be informed of how it has been used and disclosed.

12.2 Correction

You have the right to request correction of inaccurate or incomplete personal information. You can also correct AI-generated tags directly within the Service.

12.3 Deletion

You have the right to request deletion of your personal information. You can delete individual clothing items through the Service, or request full account deletion by contacting us.

12.4 Withdraw Consent

You may withdraw consent for the collection, use, or disclosure of your personal information at any time, subject to legal or contractual restrictions. We will inform you of the implications of withdrawal.

12.5 Challenge Accuracy

You have the right to challenge the accuracy and completeness of your personal information and have it amended as appropriate. To exercise any of these rights, please contact us at support@fabify.app. We will respond to your request within thirty (30) days, as required by PIPEDA.

13. Complaints

If you have a complaint about our privacy practices, please contact our Privacy Officer at support@fabify.app. We will investigate your complaint, take appropriate corrective action where warranted, and respond to you within thirty (30) days. If you are not satisfied with our response, you have the right to file a complaint with the Office of the Privacy Commissioner of Canada:

14. Children's Privacy

Fabify is not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13. If we become aware that we have collected information from a child under 13, we will take steps to delete that information promptly. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at support@fabify.app.

15. Provincial Privacy Legislation

Fabify complies with PIPEDA as the primary federal privacy framework. We also respect the rights of users located in provinces with substantially similar privacy legislation:

  • British Columbia: Personal Information Protection Act (PIPA)
  • Alberta: Personal Information Protection Act (PIPA)
  • Quebec: Act Respecting the Protection of Personal Information in the Private Sector (Law 25)

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we make material changes, we will:

  • Update the "Effective Date" and "Last Updated" dates at the top
  • Provide at least 30 days' advance notice via email or in-app notification
  • Give you the opportunity to review changes before they take effect

Continued use of the Service after updates constitutes acceptance of the revised Privacy Policy.
